Utility laws don't currently support a world where we can all thrive; however, there's much we stand to lose if we ignore them. Over the last century, vested interests have influenced the courts to weaken foundational energy utility law standards. These same interests have influenced agencies to relinquish power to the private sector.

 

Mariame Kaba has declared that "the law is not real." It is unevenly applied and much of it unjust, or in the words of Walter Echo-Hawk, "a legal fiction." Still, we have choices about how and whether to operate within existing legal frameworks, whether to contest their validity, or whether to reshape how they're defined.  We can also put forward new legal frameworks, as many successful rights-based movements of the past and present have done.
